“Happy Hour” specials on alcoholic beverages have been illegal in Indiana. That is about to change beginning July 1, 2024, when happy hours will be allowed for retailer permittees. There are restrictions on the new privilege. The happy hour privilege will allow retailers and craft manufacturers to offer discount drinks for up to a maximum of 4 hours per day (15 hours per week). A “happy hour” is not allowed from 9 PM to 3 AM. The “happy hour” may not include any games that are based on the quantity of alcoholic beverages consumed by a patron and may not give alcoholic beverages as prizes. The permittee may not sell or serve an unlimited or indefinite amount of alcoholic drinks for a fixed price, for example, “bottomless drinks.” Permittees should have policies and internal controls regarding happy hours, ensuring customer safety.
This law will help restaurants and other retailers in an increasingly difficult business environment. But, with great power comes great responsibility, so please consume responsibly.
